Returns
Subject to the provisions of the Consumer Protection Act, 2008 (“CPA”) being applicable to the Customer, the Customer may only return faulty products purchased directly from Blue Sky and in the circumstances as contemplated in Section 20 of the CPA, and further in the event that Blue Sky fails to satisfy the requirements and standards contemplated in Section 55 of the CPA, and then only within the periods set out in Section 56 of the CPA.
Subject to these provisions, the Customer shall not be entitled to return any Products to Blue Sky without Blue Sky’s prior written agreement. In the event that Blue Sky agrees to such a return of Products, otherwise than in terms of these provisions, the Customer shall pay to Blue Sky a handling fee in an amount which is equal to 10% (ten percent) of the price at which the Customer purchased the Products from Blue Sky which amount shall be deducted from the credit note issued by Blue Sky as well as any discounts or bonuses received by the Customer.
